What can I do if the listing agent of a property, in which a bank is the seller, has refused to give me?
Question by Myra: What can I do if the listing agent of a property, in which a bank is the seller, has refused to give me?
the keys to our new house after closing? The closing was yesterday and the title company did not get the keys since there was a real estate “lock box” on the door-that was their key.
We went to obtain the keys post closing but it was earlier that same removed that day. My real estate agent called the seller’s listing agent, and the listing agent removed and hid them until the funding transfer for the home loan was final. The fund transer was final earlier today (all funding wired/completed).
Additionally, there was no one living on the house, and there was no stipulation or addendum to the contract to allow the seller to delay possession of the property post-closing.
The listing agent has still not given us the keys and the contract was final yesterday. What can I do as a legal remedy in this situation? My real estate agent said this has never happened to her before.
Should I be concerned and seek legal action? This is within Florida. Is this unlawful/unethical behavior?

If you own the house now, then call a local locksmith. See your attorney on how to be reimbursed for that if you care. Probably small claims court will do the trick on that one.
