I live in Michigan. I am listed as the executor on my mothers will, who died last week. The only thing in question is her house, that is in her name alone and paid for and also her car that is also paid for. Her savings and checking her and I were on there together. A small life insurance policy is in 4 names (I have 3 sisters). Now The lawyer is telling me to open an “Estate” because of the house and it cost $ 600-$ 900 for him to do. I am real confused, I called the probate court and they said I could file the papers to become the legal executor and open a deceased estate for $ 150.00. I am not sure what I am suppose to do, where can I find correct information on this without contacting and paying big bucks for a lawyer. My mom doesn’t have much cash on hand for this. We want to list and sell the house soon. Any suggestion on what to do next would be greatly appreciated, I am overwhelmed right now.

First, sorry for your loss…Second, did your mother have all of the possessions you mentioned in the estate? If not, the paperwork down at the courthouse is the best way to go. The paperwork, however confusing it may sound, is quite easy simply follow the directions, listing the property (assets) she possessed and all of your sisters and yourself as the dissidents of the estate.
After the paperwork, you should be good. No need for the lawyer unless you have to go to probate court. Good luck, if you need any more help email me.
Also, before you list the home for sale you will want to set up the estate for tax purposes, so any distributions to the 4 of you can be insulated by the 2 million dollar rule and avoid probate.
